The U.S. Department of Education has opened an investigation into a Georgia elementary school for how it handled a case of a sexual assault that allegedly took place in a school bathroom.

This, after a district-wide policy that was kept secret from parents, allowed male students to enter the girls’ bathroom.

The Federalist reports a five-year old girl reported that a boy, who district officials now say claims to be “gender fluid,” pushed the little girl against a bathroom wall and groped her.

The victim’s mother says she was treated like the bad guy after the school sent child protective services to question her.

The school’s policy was enacted shortly after the Obama administration threatened to withhold federal funds unless schools got rid of separate bathrooms for girls and boys.
